Question: Doesn’t my bank trust (fideicomiso) protect my title?

Answer: No it does not. The fideicomiso is merely a legal instrument that enables foreigners to comply with the laws restricting fee simple title ownership of Mexican coastal properties. The Mexican bank merely acts as a fiduciary and has no responsibility to assure the title it holds in trust is not in jeopardy due to errors in departments of planning and property registry and or litigation.

Question: What are the risks of no title insurance in Mexico?

Answer: Title records in Mexico are subject to a myriad number of mistakes. Sloppy records control, conflicting recording agencies - state, federal and municipal governments often have conflicting title records. False title documents that are recorded as legitimate titles are not uncommon. There are six distinct forms of “title” ownership in Mexico which further creates confusion and legal conflicts. As a result, litigation over property ownership is considerably more probable than in the United States.
